These Terms and Conditions ("Terms") govern your access to and use of the Fusion Box platform located at app.fusionbox.ai (the "Platform"), operated by Fusion Box, operated by Virtual Benefits, Inc. ("Fusion Box," "we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
You must be at least 13 years of age to use Fusion Box. By using the Platform, you represent that you meet this requirement. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Fusion Box is a subscription-based SaaS platform providing the following features and services:
Features may be updated, added, or removed at our discretion with reasonable notice.
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Fusion Box uses SMS messages for account verification and communications. By providing your phone number during registration, you consent to receive the following types of SMS messages from Fusion Box:
Message Frequency: Varies based on account activity. OTP messages are sent only when you initiate a login or verification action.
Message & Data Rates: Standard message and data rates from your carrier may apply.
Opt-Out: Reply STOP to any SMS message to unsubscribe from non-essential messages. Note that opting out of OTP messages may prevent you from logging in to your account.
Help: Reply HELP to any SMS message or contact [email protected] for assistance.
FusionBox offers subscription-based access to the Platform. Plan details, features, and pricing are described on the Platform. Subscriptions automatically renew unless cancelled before the renewal date.
Primary subscription purchases are processed through Authorize.Net. Organizational administrators may also configure Stripe as a payment processor for their instance. All payment information is handled by the respective payment processor and is subject to their terms and privacy policies. Fusion Box does not store raw payment card data.
Certain features including AI Course Generation and Custom Domain Integration are available as paid add-ons. These are purchased through the super admin and processed via Authorize.Net.
All purchases are generally non-refundable unless otherwise stated or required by applicable law. If you believe you were charged in error, contact [email protected] within 14 days of the charge.
You retain ownership of content you create or upload to Fusion Box, including course materials, journal entries, community posts, and podcast files ("User Content"). By submitting User Content, you grant Fusion Box a non-exclusive, royalty-free, worldwide license to host, display, and distribute your content solely for the purpose of operating and providing the Platform.
You agree not to post or transmit content that:
When using AI Course Generation features, content is generated using third-party AI APIs (Anthropic Claude and OpenAI). You are responsible for reviewing AI-generated content before publishing. Fusion Box does not guarantee the accuracy of AI-generated content.
You agree not to:
Organizations that purchase custom domain integration may configure Fusion Box to operate under their own domain. Fusion Box remains the underlying service provider. You are responsible for maintaining valid domain registration and ensuring your use of the custom domain complies with applicable laws and does not infringe third-party rights.
The Fusion Box Platform, including its design, code, trademarks, and content created by Fusion Box, is the exclusive property of Fusion Box, operated by Virtual Benefits, Inc. and is protected by applicable intellectual property laws. These Terms do not grant you any rights in Fusion Box's intellectual property except the limited license to use the Platform as described herein.
Fusion Box reserves the right to suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. You may cancel your account at any time by contacting [email protected]. Upon termination, your right to access the Platform ceases and we may delete your data subject to our retention policies.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FUSIONBOX DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUSIONBOX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO FUSIONBOX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Fusion Box, operated by Virtual Benefits, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your User Content, or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Iowa. You waive any objection to jurisdiction or venue in such courts.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
